Ad hoc topic coverage and unknown authorship add further vulnerabilities.<\/p>\n<p>\u201c<span class=\"s1\">The worst outcome would be for a judge\u2019s reliance on Wikipedia to lead them to decide a case differently than they would have if they had read either an expert secondary source or the cited precedent itself,\u201d said Thompson.<\/span><\/p>\n<p><span class=\"s1\">\u201cEven without any difference in outcome, however, judges\u2019 reliance on Wikipedia to determine the applicable law undermines the litigant\u2019s expectation that the court\u2019s reasoning is the product of expertise alone.\u201d<\/span><\/p>\n<h2>Legal precedents<\/h2>\n<p>The study focused on Wikipedia\u2019s influence on&nbsp;judges in Ireland.<\/p>\n<p>The country shares key similarities with other <a href=\"https:\/\/www.theguardian.com\/law\/2022\/feb\/12\/what-is-common-law-and-why-is-it-being-misinterpreted\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">common law<\/a> systems, such as US and UK. Notably, lower courts are bound by the decisions made in higher courts, while judges cite previous cases to determine the applicable legal principle.<\/p>\n<p>Unlike in the US, however, decisions made in Irish courts are rarely covered in Wikipedia,&nbsp;which makes it easier to analyze the impact of new entries.<\/p>\n<p><span class=\"s1\"><\/p>\n<blockquote class=\"c-richText__pullQuote\" readability=\"29.5\">\n<div class=\"c-richText__pullQuoteGradient\" readability=\"33\">\n<p class=\"c-richText__pullQuoteQuote\">Given the greater coverage of US court cases on Wikipedia, its influence might be even larger.<\/p>\n<\/p><\/div>\n<\/blockquote>\n<p><\/span><\/p>\n<p>The researchers created 154 new Wikipedia entries on Irish Supreme Court cases. Most were written were law students under faculty supervision.<\/p>\n<p>Each author had access to relevant legal materials, but their names, expertise, and potential biases were opaque.<\/p>\n<p>Half the articles were randomly selected for upload to Wikipedia, where judges, clerks, and lawyers could access them.&nbsp; The other half were kept offline. They further measured whether the arguments in court judgments echoed the Wikipedia pages.<\/p>\n<h2>The verdict<\/h2>\n<p>The study found that a Wikipedia article increases a case\u2019s citations in Ireland by more than 20%.
