The chip firm Arm, for instance, earned <\/span><a href=\"https:\/\/nvidianews.nvidia.com\/news\/nvidia-to-acquire-arm-for-40-billion-creating-worlds-premier-computing-company-for-the-age-of-ai\" target=\"_blank\" rel=\"nofollow noopener noreferrer\"><span>a $40 billion valuation<\/span><\/a><span> and a reputation as the UK\u2019s leading tech company \u2014 despite never manufacturing a single chip. Instead, the company designs the processor architecture that\u2019s used in countless devices.<\/span><\/p>\n<p><span>This intellectual property-based <a href=\"https:\/\/thenextweb.com\/topic\/business\" target=\"_blank\" rel=\"noopener noreferrer\">business<\/a> model<\/span> has transformed stock markets. In 1985, under a third of all assets in the S&amp;P 500 were classed as intangible by 2020, that proportion had risen to <a href=\"https:\/\/www.oceantomo.com\/intangible-asset-market-value-study\/#:~:text=We%20find%20that%20COVID%2D19,shown%20in%20the%20chart%20below.\" target=\"_blank\" rel=\"nofollow noopener noreferrer\"><span>around 90%<\/span><\/a><span>. Startups, however, can overlook IP protection in their initial&nbsp;plans.<\/span><\/p>\n<p><span>According to Robert Lind, a patent attorney at IP firm Marks &amp; Clerk, they\u2019re taking a major risk. Lind recently wrote <\/span><a href=\"https:\/\/www.marks-clerk.com\/insights\/resources\/the-ip-driven-start-up-robert-lind\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\"><span>an e-book<\/span><\/a><span> on how to protect and monetize their intellectual property. He shared his top tips with TNW.<\/span><\/p>\n<h2>1. He advises them to start their research before they really need it.<\/span><\/p>\n<p><span>Naturally, Lind suggests their study material includes his e-book. But he doesn\u2019t recommend relying on professional advisors at every turn.<\/span><\/p>\n<p><span>\u201cArm yourself with the knowledge at the outset, so you know when to bring in the experts \u2014 and when you don\u2019t need to bring them in,\u201d says Lind.&nbsp;<\/span><\/p>\n<p><span>For tech startups, patents are the primary form of IP that can be protected. <a href=\"https:\/\/thenextweb.com\/topic\/founders\" target=\"_blank\" rel=\"noopener noreferrer\">Founders<\/a> should educate themselves on what a patent is, how to get them, how they\u2019re enforced, and how third-party patents can be interpreted.<\/span><\/p>\n<h2>2. Keep it confidential<\/h2>\n<p><span>It should go without saying that your brilliant idea should be kept private, but that\u2019s easier said than done.&nbsp;<\/span><\/p>\n<p><span>\u201c\u200b\u200bGoing public doesn\u2019t just mean selling a product,\u201d says Lind. \u201cIt could mean presenting a conference paper, publishing an article in a journal, or putting some information on your website. Be very careful about publishing your ideas before you\u2019ve taken a view on whether something\u2019s patentable.\u201d<\/span><\/p>\n<h2>3. Diligently identify your innovations<\/h2>\n<p><span>Innovations are the lifeblood of patents, but they\u2019re not always easy to identify. Protect your rights<\/h2>\n<p><span>Experienced investors are savvy about the value of IP. Venture capitalists will use patents as evidence that a company is well-managed, at a certain development stage, and with a market niche. Their due diligence will likely differentiate between filing an application and receiving a granted patent.<\/span><\/p>\n<p><span>Startups, however, often prioritize investing in R&amp;D over protecting their IP. Lind recalls this issue emerging at a green tech company. The team had a very slim IP portfolio, which raised questions about its value to investors.&nbsp;<\/span><\/p>\n<p><span>\u201cIt\u2019s the protection that really crystallizes the value in the R&amp;D that you\u2019re doing,\u201d says Lind.<\/span><\/p>\n<h2>5. Devise a clear IP strategy<\/h2>\n<p><span>An IP strategy should begin with clear objectives. Broadly, this will involve maximizing value at a desired point of exit or investment, while remaining within the confines of financial prudency.&nbsp;<\/span><\/p>\n<p><span>Registered rights are territorial, so you\u2019ll need to identify where to register your IP assets. This analysis can incorporate the territory\u2019s size, potential, costs, and effectiveness.&nbsp;<\/span><\/p>\n<p><span>A cautious strategy can defer costs and commitments, but bear in mind that the registration process can be slow. To avoid delays, file early in the key territories, respond quickly to objections, and embrace opportunities to discuss issues with patent examiners. Careful cost forecasting and budgeting will help cover any pitfalls that emerge.<\/span><\/p>\n<p><span>\u201cYou should pursue your strategy quite aggressively,\u201d says Lind. \u201cBut unless you know where you want to get to at the start, you\u2019re probably not going to get anywhere useful.\u201d<\/span><\/p>\n<h2>6. Map your IP to your business \u2014 and the future<\/h2>\n<p><span>You need to make sure your IP maps to the tech you can sell. One of Lind\u2019s previous clients, <\/span><a href=\"https:\/\/www.dnanudge.com\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\"><span>DNANudge<\/span><\/a><span>, raised $60 million after building a portfolio of patent rights with diverse potential. While the company already sells a consumer product, its IP could also be integrated into various other devices or apps.<\/span><\/p>\n<p><span>\u201cMake sure your IP is broad enough in scope to cover not just what you\u2019re doing now but also what you\u2019re doing in the future,\u201d suggests Lind.<\/span><\/p>\n<h2>7. Keep building your portfolio<\/h2>\n<p><span>Lind advises startups to look beyond those first few patents for their big idea. After all, each patent only lasts for 20 years.<\/span><\/p>\n<p><span>\u201cA slow-burn startup might take 10 years to get its product to market, which only leaves them with 10 years left on the patent,\u201d says Lind. \u201cThey\u2019ve got to keep innovating and keep patenting so they can keep that pipeline going.\u201d<\/span><\/p>\n<h2>8. Resolve your ownership issues<span><\/span><\/h2>\n<p><span>The cooperation of staff can be crucial to registering IP. Signatures from inventors, designers, directors, and owners may all be required on legal documents.
