How EU and UK differ in their approach to AI"},"content":{"rendered":"\n<div><img decoding=\"async\" src=\"https:\/\/img-cdn.tnwcdn.com\/image\/tnw-blurple?filter_last=1&amp;fit=1280%2C640&amp;url=https%3A%2F%2Fcdn0.tnwcdn.com%2Fwp-content%2Fblogs.dir%2F1%2Ffiles%2F2024%2F04%2FUntitled-design-54.jpg&amp;signature=be326905e156082265cde65e606111a8\" class=\"ff-og-image-inserted\"><\/div>\n<p>The boom of <a href=\"https:\/\/thenextweb.com\/topic\/artificial-intelligence\" target=\"_blank\" rel=\"noopener\">artificial intelligence<\/a> has spurred a regulatory frenzy across the globe \u2014 and <a href=\"https:\/\/thenextweb.com\/topic\/europe\" target=\"_blank\" rel=\"noopener\">Europe<\/a> is at the forefront of the developments.<\/p>\n<p>Both the EU and the <a href=\"https:\/\/thenextweb.com\/topic\/uk\" target=\"_blank\" rel=\"noopener\">UK<\/a> are attempting to find the elusive balance between leveraging AI\u2019s growth and mitigating potential risks \u2014 but their approaches differ significantly.<span> <\/span><\/p>\n<p><span>The former has opted for a hands-on, risk-based approach, whereas the latter has promised a \u201cpro-innovation\u201d stance. It also establishes the European <a href=\"https:\/\/thenextweb.com\/topic\/ai\" target=\"_blank\" rel=\"noopener\">AI<\/a> Office, which will oversee the law\u2019s implementation.<\/p>\n<p>In contrast, the UK hasn\u2019t opted for bespoke legislation so far. Instead, it has proposed a guidance framework for existing regulatory bodies. For this reason, the government has pledged \u00a310mn to prepare and upskill regulators so they can evaluate the opportunities and risks associated with the technology.<\/p>\n<p>The UK is also following a vertical strategy. Its aim to evaluate risks sector-by-sector based on five principles:<\/p>\n<ul>\n<li>Safety, security, and robustness.<\/li>\n<li>Appropriate transparency and explainability.<\/li>\n<li>Fairness.<\/li>\n<li>Accountability and governance.<\/li>\n<li>Contestability and redress.<\/li>\n<\/ul>\n<p>\u201cBy taking an agile, sector-specific approach, we have begun to grip the risks immediately, which in turn is paving the way for the UK to become one of the first countries in the world to reap the benefits of AI safely,\u201d Michelle Donelan, Secretary of State for Science, Innovation, and Technology, <a href=\"https:\/\/www.gov.uk\/government\/consultations\/ai-regulation-a-pro-innovation-approach-policy-proposals\/outcome\/a-pro-innovation-approach-to-ai-regulation-government-response\" target=\"_blank\" rel=\"nofollow noopener\">said<\/a> in February.<\/p>\n<h2>The EU\u2019s risk-based approach<\/h2>\n<p>The EU lawmakers on the other hand, believe that it is a risk-based approach and the <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/statement_24_1465\" target=\"_blank\" rel=\"nofollow noopener\">push for trustworthy AI<\/a> that will unlock Europe\u2019s competitive advantage.<\/p>\n<p>The bloc\u2019s rules target AI systems based on risk levels: unacceptable, high, limited, and minimal risk. AI tools that threaten safety and human rights, such as social scoring, are considered unacceptable, and are therefore banned altogether.<\/p>\n<p>For the remaining categories, the concept is simple: the higher the risk, the tougher the rules. High-risk systems, for example, include AI technologies that can be used in law enforcement, healthcare, and critical infrastructure.<\/p>\n<p>The AI Act applies to all AI companies (within or outside the EU) doing business in the bloc. Rule violations can lead to fines of up to 7% of a company\u2019s global turnover.<\/p>\n<p>In contrast, the UK is currently targeting voluntary agreements on AI safety with key companies and countries.<\/p>\n<h2>To legislate or not to legislate?<\/h2>\n<p>Critics have expressed concerns over the AI Act, fearing that the strict rules could <a href=\"https:\/\/thenextweb.com\/news\/eu-ai-act-leak-removes-dobuts\" target=\"_blank\" rel=\"noopener\">impede innovation.<\/a> European companies have also <a href=\"https:\/\/thenextweb.com\/news\/open-letter-eu-ai-act-regulation-stifle-innovation-artificial-intelligence\" target=\"_blank\" rel=\"noopener\">raised objections<\/a>, warning that the EU could lose its competitiveness in the field.<\/p>\n<p>But the UK might also be diverting from its pro-innovation, laissez-faire strategy before long.<\/p>\n<p>The government is starting to draft its own legislation on artificial intelligence, people familiar with the matter<a href=\"https:\/\/archive.is\/20240415053641\/https:\/\/www.ft.com\/content\/311b29a4-bbb3-435b-8e82-ae19f2740af9#selection-2271.0-2271.287\" target=\"_blank\" rel=\"nofollow noopener\"> told the Financial Times<\/a>. The regulation would most likely limit the development of Large Language Models (LLMs) and require companies building advanced AI to share their algorithms with the government.<\/p>\n<p>Related concerns range from potential misuse to market manipulation.<\/p>\n<p>\u201cThe essential challenge we face is how to harness this immensely exciting technology for the benefit of all, while safeguarding against potential exploitation of market power and unintended consequences,\u201d <a href=\"https:\/\/www.gov.uk\/government\/news\/cma-outlines-growing-concerns-in-markets-for-ai-foundation-models\" target=\"_blank\" rel=\"nofollow noopener\">said<\/a> Sarah Cardell, CEO of the UK\u2019s Competition and Markets Authority (CMA).<\/p>\n<p><i><span>One of the themes of this year\u2019s TNW Conference is Ren-AI-ssance: The AI-Powered Rebirth.
