{"id":15590,"date":"2024-09-03T13:39:27","date_gmt":"2024-09-03T13:39:27","guid":{"rendered":"http:\/\/TheNextWeb=1409853"},"modified":"2024-09-03T13:39:27","modified_gmt":"2024-09-03T13:39:27","slug":"the-dutch-are-having-none-of-clearview-ai-harvesting-your-photos","status":"publish","type":"post","link":"https:\/\/www.londonchiropracter.com\/?p=15590","title":{"rendered":"The Dutch are having none of Clearview AI harvesting your photos"},"content":{"rendered":"\n<p>GDPR fines keep amassing for Clearview AI \u2014 a US-based startup known for its thorough (and potentially perilous) facial recognition services.<\/p>\n<p>Following similar measures by data protection authorities in <a href=\"https:\/\/www.edpb.europa.eu\/news\/national-news\/2022\/french-sa-fines-clearview-ai-eur-20-million_en\" target=\"_blank\" rel=\"nofollow noopener\">France<\/a>, <a href=\"https:\/\/www.edpb.europa.eu\/news\/national-news\/2022\/facial-recognition-italian-sa-fines-clearview-ai-eur-20-million_en\" target=\"_blank\" rel=\"nofollow noopener\">Italy<\/a>, and <a href=\"https:\/\/www.edpb.europa.eu\/news\/national-news\/2022\/hellenic-dpa-fines-clearview-ai-20-million-euros_en\" target=\"_blank\" rel=\"nofollow noopener\">Greece<\/a>, the Netherlands\u2019 DPA today hit Clearview with a \u20ac30.5mn fine for its \u201cillegal\u201d database of photos.<\/p>\n<p>This brings the company\u2019s total fines in the EU to \u20ac90.5mn.<\/p>\n<p>Clearview offers its facial recognition solutions to intelligence and investigative services, which can benefit from a database of over 50 billion facial images. For this database, the <a href=\"https:\/\/thenextweb.com\/topic\/startup-company\" target=\"_blank\" rel=\"noopener\">startup<\/a> is collecting photos from public web sources. Sign up now!<\/p>\n<\/div>\n<\/div>\n<\/div>\n<p>In essence, this means that a photo you or I may have on Facebook or Instagram is likely to be part of Clearview\u2019s database, <span>enabling potential tracking and identification<\/span>. Naturally, without our knowledge or consent.<\/p>\n<p>\u201cThis is not a doom scenario from a scary film. Nor is it something that could only be done in China,\u201d <a href=\"https:\/\/www.autoriteitpersoonsgegevens.nl\/en\/current\/dutch-dpa-imposes-a-fine-on-clearview-because-of-illegal-data-collection-for-facial-recognition\" target=\"_blank\" rel=\"nofollow noopener\">said<\/a> DPA chairman Aleid Wolfsen.<\/p>\n<h2>Clearview\u2019s GDPR violations<\/h2>\n<p>Following investigation, the DPA confirmed that photos of Dutch citizens are included in the database. It also found that Clearview is accountable for two GDPR breaches.<\/p>\n<p>The first is the collection and use of photos.<\/p>\n<p>\u201cClearview should never have built the database with photos, the unique biometric codes, and other information linked to them,\u201d the data authority said.<\/p>\n<p>The second is the lack of transparency. According to the DPA, the startup doesn\u2019t offer sufficient information to individuals whose photos are used, nor does it provide access to which <a href=\"https:\/\/thenextweb.com\/topic\/data\" target=\"_blank\" rel=\"noopener\">data<\/a> the company has about them.<\/p>\n<p><span>A Clearview public relations spokesperson emailed TNW a written statement from the startup\u2019s Chief Legal Officer, Jack Mulcaire.<\/span><\/p>\n<p>\u201cClearview AI does not have a place of business in the Netherlands or the EU, it does not have any customers in the Netherlands or the EU, and does not undertake any activities that would otherwise mean it is subject to the GDPR,\u201d Mulcaire said.<\/p>\n<p>\u201cThis decision is unlawful, devoid of due process and is unenforceable.\u201d<\/p>\n<p>But according to the DPA, the company hasn\u2019t objected to the decision and is unable to appeal against the fine.<\/p>\n<p>The Dutch authority is also levying an extra \u20ac5.1mn penalty for non-compliance if Clearview doesn\u2019t stop the violations. In addition, the DPA will investigate whether it can hold the management of the company \u201cpersonally liable\u201d \u2014 and therefore, subject to fines.<\/p>\n<p>Expectedly, the use of Clearview\u2019s technology by Dutch organisations is now prohibited.<\/p>\n<p>\u201cFacial recognition is a highly intrusive technology, that you cannot simply unleash on anyone in the world,\u201d Wolfsen said.<\/p>\n<p>Meanwhile, just last week the DPA <a href=\"https:\/\/thenextweb.com\/news\/netherlands-uber-fine-transfer-driver-data-us\" target=\"_blank\" rel=\"noopener\">hit Uber with a \u20ac290mn fine<\/a> for transferring \u201csensitive\u201d driver data to the US.
