However, in the UK, the story has passed a crucial milestone.<\/p>\n<p>As the UK supreme court has ruled today, Uber must classify its drivers as employees. As a result it must provide a minimum wage and holiday pay for its workers, <a href=\"https:\/\/www.bbc.com\/news\/business-56123668\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">BBC reports<\/a>.<\/p>\n<p>This appears to be the final ruling for Uber in the United Kingdom. The \u201cnot a taxi-firm\u201d ride hailing service has already appealed three previous court decisions in the UK, all of which said that drivers should not be considered independent.<\/p>\n<p>With the latest ruling coming from the nation\u2019s supreme court, there\u2019s nowhere left for Uber to appeal. The courts ruling says a driver should be considered working not just when driving a passenger, but when they are logged int the app.<\/p>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"text-block\" readability=\"24.038167938931\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\" readability=\"26.549618320611\">\n<p><em>[Read: <a href=\"https:\/\/thenextweb.com\/plugged\/2020\/11\/27\/build-pet-friendly-gadget-experts-animal-owners-design\/\">How do you build a pet-friendly gadget? We asked experts and animal owners<\/a>]<\/em><\/p>\n<p>As cited by the Beeb, the court backed up its decision citing four key factors, if ever you needed a clear description of why drivers should be considered employees here they are:<\/p>\n<\/div>\n<\/div>\n<div class=\"ssrcss-uf6wea-RichTextComponentWrapper e1xue1i83\" data-component=\"unordered-list-block\">\n<div class=\"ssrcss-3z08n3-RichTextContainer e5tfeyi2\">\n<div class=\"ssrcss-1pzprxn-BulletListContainer e5tfeyi3\">\n<ul role=\"list\">\n<li>Uber sets the fare, in other words, it controls how much drivers earn.<\/li>\n<li>Uber dictates its contract terms, drivers don\u2019t get a look in on these.<\/li>\n<li>Ride requests are controlled by Uber, the company can delegate work and penalize drivers that don\u2019t accept requests.<\/li>\n<li>Uber has the power to remove a driver from its platform if their reviews are bad.<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<p>While Uber does afford drivers a huge amount of flexibility and control over when they work, the bits that really matter when it comes to running a business are controlled and run by the ride-sharing firm.<\/p>\n<p>Under Uber\u2019s iron fist, drivers are not independent workers, free to dictate the exact terms of how they work, what they earn, and how they handle complaints. <a href=\"https:\/\/thenextweb.com\/shift\/2020\/07\/20\/uk-uber-drivers-companys-euro-hq-prove-ride-hailing-business-employer-algorithm-transparency\/\" target=\"_blank\" rel=\"noopener noreferrer\">They are subordinates in the gig-work empire<\/a>, or if you prefer something more visceral, they are exploited workers.<\/p>\n<p>Earlier this week, Uber <a href=\"https:\/\/techcrunch.com\/2021\/02\/15\/uber-lobbies-for-prop-22-style-gig-work-standards-in-the-eu\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">outlined its plans<\/a> to bring its California-oriented \u201cProp 22\u201d standards for gig-work to the EU. While the UK is no longer part of the European Union, its supreme court\u2019s ruling sets an undeniable precedent that\u2019s at odds with the ruling from the US last year.<\/p>\n<p>Last November, <a href=\"https:\/\/thenextweb.com\/shift\/2020\/11\/04\/prop-22-passes-uber-and-lyft-drivers-will-continue-as-independent-contractors-in-california\/\" target=\"_blank\" rel=\"noopener noreferrer\">US voters passed Prop 22 in California<\/a> meaning that firms reliant on gig-workers, like Uber, Lyft, and DoorDash, don\u2019t have to pay a full suite of employee benefits like health care, paid sick leave, and holiday pay. But they do give drivers some perks they didn\u2019t have previously, <a href=\"https:\/\/thenextweb.com\/shift\/2020\/11\/04\/prop-22-passes-uber-and-lyft-drivers-will-continue-as-independent-contractors-in-california\/\" target=\"_blank\" rel=\"noopener noreferrer\">you can read more about that here<\/a> and <a href=\"https:\/\/thenextweb.com\/shift\/2020\/08\/24\/proposition-22-uber-and-lyfts-last-ditch-attempt-to-keep-their-business-model-alive\/\" target=\"_blank\" rel=\"noopener noreferrer\">here<\/a>.<\/p>\n<p>Ultimately, Prop 22 is still weighted in Uber\u2019s favor.
