On paper, this feels like any other AI project\u2019s training method. But several people took to Twitter criticizing GitHub\u2019s move and calling it a copyright violation.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"9.6396396396396\">\n<p lang=\"en\" dir=\"ltr\">\u201cI\u2019m leaving GitHub because copilot uses my OpenSource code for training\u201d is such an odd move. Anyone can fork it to there and GitHub can feed OpenSource code from anywhere to it and US copyright law permits this. Trying to prevent this practice would just end in tighter copyright laws, which would undermine copyleft more than Github\u2019s tool.<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<p>She also added that text and data mining is not against copyright laws. Plus, machine-generated work \u2014 in this case, code snippets generated by the Copilot tool \u2014 can\u2019t be called derivative work, and is not covered under intellectual property rules:<\/p>\n<blockquote readability=\"11\">\n<p><span>On the other hand, the argument that the outputs of GitHub Copilot are derivative works of the training data is based on the assumption that a machine can produce works. This assumption is wrong and counterproductive. Copyright law has only ever applied to intellectual creations \u2013 where there is no creator, there is no work. This means that machine-generated code like that of GitHub Copilot is not a work under copyright law at all, so it is not a derivative work either.<\/span><\/p>\n<\/blockquote>\n<p><span>There\u2019s&nbsp;<\/span><a class=\"c-link\" href=\"https:\/\/www.lexology.com\/library\/detail.aspx?g=02659151-af56-4617-ba3e-1d81bf35b843\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-stringify-link=\"https:\/\/www.lexology.com\/library\/detail.aspx?g=02659151-af56-4617-ba3e-1d81bf35b843\" data-sk=\"tooltip_parent\">a lot<\/a><span>&nbsp;<\/span><a class=\"c-link\" href=\"https:\/\/www.lexology.com\/library\/detail.aspx?g=02659151-af56-4617-ba3e-1d81bf35b843\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-stringify-link=\"https:\/\/www.lexology.com\/library\/detail.aspx?g=02659151-af56-4617-ba3e-1d81bf35b843\" data-sk=\"tooltip_parent\">of debate<\/a><span>&nbsp;going on around the world related to tweaking IP-related policies when it comes to machine-generated work, but it\u2019ll take a while till these arguments will be put to bed.
