While the ruling could bring a major pivot point for either of the companies, it might also affect us as consumers. By that logic, you couldn\u2019t install Fortnite on your phone. Plus V-bucks were cheaper to buy outside the iOS ecosystem.<\/p>\n<p>To fight Apple\u2019s control over installing apps on your iPhone, Epic <a href=\"https:\/\/www.polygon.com\/2020\/8\/17\/21372119\/fortnite-apple-google-sued-epic-games-lawsuit\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">filed a lawsuit against the company<\/a> in August 2020.&nbsp;In May, both companies fought against each other to make their case in <a href=\"https:\/\/www.bbc.com\/news\/technology-57199547\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">a trial that lasted nearly three weeks<\/a>.<\/p>\n<h2>Epic\u2019s argument<\/h2>\n<p>The game company and founder Tim Sweeny\u2019s demand is simple: scrap the 30% cut rule enforced in the App&nbsp;Store and give ways for people to pay for services or install apps in a different way. Sweeny has also tried to win public sympathy with marketing campaigns, such as&nbsp;<a href=\"https:\/\/www.polygon.com\/2020\/8\/13\/21367803\/fortnite-1984-apple-app-store-epic-lawsuit-commercial-short-video\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">mocking Apple\u2019s 1984 ad<\/a> and #FreeFortnite.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"7.0604651162791\">\n<p lang=\"en\" dir=\"ltr\">Participated in the <a href=\"https:\/\/twitter.com\/hashtag\/FreeFortnite?src=hash&amp;ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">#FreeFortnite<\/a> cup. 12 matches, 3 eliminations, 30 points. Am I the only one competing as Jellie? <a href=\"https:\/\/t.co\/7RgqHx0dp9\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">https:\/\/t.co\/7RgqHx0dp9<\/a><a href=\"https:\/\/t.co\/TpxdKAnWuI\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">pic.twitter.com\/TpxdKAnWuI<\/a><\/p>\n<p>\u2014 Tim Sweeney (@TimSweeneyEpic) <a href=\"https:\/\/twitter.com\/TimSweeneyEpic\/status\/1297643152615014400?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">August 23, 2020<\/a><\/p>\n<\/blockquote>\n<p>Epic also argued that&nbsp;Apple gave special treatment to companies like <a href=\"https:\/\/www.cbsnews.com\/news\/epic-apple-lawsuit-what-we-learned\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Netflix and offered them a better deal<\/a>.<\/p>\n<p>Plus, there was a whole argument about how Fortnite is a \u2018Metaverse\u2019, and not just a game \u2014 so Apple should treat it as a platform. There was a lot of back and forth between the two companies around the definition of a game. You can read more about that <a href=\"https:\/\/www.nme.com\/features\/epic-games-apple-fortnite-metaverse-court-2936878\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">here<\/a>.<\/p>\n<p>The game company wanted to break Apple\u2019s illusion of App Store\u2019s quality control by bringing forward <a href=\"https:\/\/www.theverge.com\/2021\/5\/6\/22423567\/apple-epic-app-store-policies-fortnite-trial-day-4\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">developer testimonies<\/a> that complained about \u201carbitrary review processes\u201d and the issue of many \u201coutdated, low-quality apps\u201d on the app distribution platform.<\/p>\n<h2>Apple\u2019s argument<\/h2>\n<p>There\u2019s no denying that the App Store for iPhones and iPads is a walled garden. But Apple says it\u2019s that way for a reason.<\/p>\n<p>Apple allows you to install third-party apps on Mac. To that argument, Apple\u2019s VP, Craig Frederighi, said that <a href=\"https:\/\/www.engadget.com\/apple-craig-federighi-mac-os-220134152.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Mac is like driving a car you need to drive responsibly<\/a>, unlike iOS:<\/p>\n<p>\u201cWith iOS, we were able to create something where children \u2014 heck, even infants \u2014 are able to operate an iOS device and be safe in doing so. It\u2019s really a different product.\u201d<\/p>\n<p><iframe loading=\"lazy\" width=\"500\" height=\"281\" src=\"https:\/\/www.youtube.com\/embed\/K2O1dQ2IhTA?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture\" allowfullscreen>[embedded content]<\/iframe><\/p>\n<p>Last month, the company also wrote <a href=\"https:\/\/thenextweb.com\/news\/apple-only-our-app-store-can-protect-your-iphone-from-sideloaded-malware\">a lengthy whitepaper<\/a> arguing about the dangers of sideloading and how it has affected Android. It also made a strong argument about how App Store is the best protection for you against these hazards.<\/p>\n<p>Apple has repeatedly argued that the App Store helps developers earn money in a big way. In 2020, its <a href=\"https:\/\/www.cnbc.com\/2021\/01\/08\/apples-app-store-had-gross-sales-around-64-billion-in-2020.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">gross sales were estimated to be $64 billion<\/a>. That means the company earned billions of dollars through the commission.<\/p>\n<p>When CEO Tim Cook took the stand, he evaded the question about the App Store\u2019s earnings and said he had a <span>\u201cfeeling\u201d that it was profitable. Come on Tim, you don\u2019t get to multi-trillion dollar market cap without knowing numbers, do you?<\/span><\/p>\n<p>He also said that the fee also includes Apple\u2019s intellectual property work as the company has made the platform ripe for distribution:<\/p>\n<blockquote readability=\"6\">\n<p><span>If we allowed people to link out like that, we would in essence give up our total return on our IP.<\/span><\/p>\n<\/blockquote>\n<h2>What\u2019s in it for you?<\/h2>\n<p>If you\u2019re a user waiting for Fortnite to return to iPhones, there\u2019s no straight answer right now. It\u2019s unlikely that the federal Judge Yvonne Gonzalez Rogers will rule entirely in favor of either of the companies. Plus, she has to go through more than 4,500 pages of testimonies. So we might not get a result soon.<\/p>\n<p>During the closing arguments, she acknowledged that the App Store had some monopolistic tendencies, but courts don\u2019t run businesses. So it might hard to pass a solid verdict like asking Apple to allow alternative app stores.<\/p>\n<p>Judge Gonzalez Rogers didn\u2019t give Epic a free pass, and <a href=\"https:\/\/9to5mac.com\/2021\/05\/24\/apple-vs-epic-adjourns\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">said<\/a> the company has \u201culterior motives\u201d for a favorable outcome:<\/p>\n<blockquote readability=\"8\">\n<p>Epic is here because if relief is granted, they go from a multibillion-dollar company to a maybe-trillion-dollar company, who knows. But they won\u2019t do it out of the kindness of their heart.<\/p>\n<\/blockquote>\n<p>It\u2019s important to keep in mind that Apple has earned over <a href=\"https:\/\/www.macrumors.com\/2021\/05\/19\/apple-earned-over-100-million-from-fortnite\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">$100 million from Fortnite<\/a>, as revealed during the trial. While the iPhone maker is now a $2 trillion market cap company, it\u2019s no small amount by any means.<\/p>\n<p>There is a chance that the judge might ask Apple to tweak its guidelines, and Epic to make some compromises to its stance.<\/p>\n<p>As Cook said during the trial, \u201cThe user is caught between two companies.\u201d It\u2019s best for these two to make amends.<\/p>\n<p><i>Did you know we have a newsletter all about consumer tech?
