{"id":690,"date":"2020-10-27T09:27:09","date_gmt":"2020-10-27T09:27:09","guid":{"rendered":"https:\/\/thenextweb.com\/?p=1325505"},"modified":"2020-10-27T09:27:09","modified_gmt":"2020-10-27T09:27:09","slug":"uber-is-being-sued-by-drivers-claiming-to-have-been-sacked-by-its-algorithm","status":"publish","type":"post","link":"https:\/\/www.londonchiropracter.com\/?p=690","title":{"rendered":"Uber is being sued by drivers claiming to have been sacked by its algorithm"},"content":{"rendered":"\n<p><span>A group of Uber drivers have filed a legal case in Amsterdam claiming that the platform\u2019s algorithm unfairly dismissed them from the service without appeal.<\/span><\/p>\n<p><a class=\"c-link\" href=\"https:\/\/nos.nl\/artikel\/2353874-chauffeurs-uber-algoritmes-bepalen-wie-ontslagen-wordt.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\" data-stringify-link=\"https:\/\/nos.nl\/artikel\/2353874-chauffeurs-uber-algoritmes-bepalen-wie-ontslagen-wordt.html\" data-sk=\"tooltip_parent\" aria-describedby=\"sk-tooltip-7784\">Dutch news outlet NOS<\/a><span>&nbsp;reports that four Uber drivers, three British and one Portuguese, filed the case at a district court yesterday<\/span>. The drivers say automated firing is not allowed and according to European law, there must be human intervention before such an important decision is made.<\/p>\n<p>Uber is contesting the claims, and <a href=\"https:\/\/www.bbc.com\/news\/business-54698858\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">told the BBC<\/a> that humans had intervened before the drivers\u2019 accounts were deactivated.<\/p>\n<p>\u201cAs part of our regular processes, the drivers in this case were only deactivated after manual reviews by our specialist team,\u201d the spokeswoman told the BBC.<\/p>\n<p>While the case affects all Uber drivers, it\u2019s being logged in Amsterdam, the Netherlands, as that\u2019s where the ride-sharing company maintains its data.<\/p>\n<p><em>[Read: <a href=\"https:\/\/thenextweb.com\/politics\/2020\/10\/16\/what-audience-intelligence-data-tells-us-about-the-2020-us-presidential-election\/\" target=\"_blank\" rel=\"noopener noreferrer\">What audience intelligence data tells us about the 2020 US presidential election<\/a>]<\/em><\/p>\n<p>The drivers are being represented by Dutch legal firm <a href=\"https:\/\/ekker.legal\/2020\/10\/26\/uber-drivers-challenge-dismissal-by-algorithm\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Ekker, led by attorney Anton Ekker<\/a>. Ekker <a href=\"https:\/\/ekker.legal\/2020\/10\/26\/uber-drivers-challenge-dismissal-by-algorithm\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">says<\/a> the case will \u201ctest the extent that Article 22 of the EU General Data Protection Regulation (GDPR) can protect individuals from unfair automated decision-making.\u201d<\/p>\n<p>Under Article 22, individuals are protected from automated decisions with no human intervention, which can lead to negative outcomes, such as someone losing their job. In short, drivers have a right to the data gathered about them that contributed to the decision being made.<\/p>\n<p>According to the App Drivers and Couriers Union (ADCU) there have been more than 1,000 individual cases since 2018 where drivers have been dismissed from the app without appeal.<\/p>\n<p>Now that Uber has been <a href=\"https:\/\/thenextweb.com\/shift\/2020\/09\/28\/uber-is-here-to-stay-in-london-for-now-despite-its-long-history-of-safety-concerns\/\" target=\"_blank\" rel=\"noopener noreferrer\">granted its London operating license<\/a>, this case becomes even more pertinent in the UK capital. Any time a private hire vehicle operator, like Uber, fires a driver, they must report that individual to Transport for London so there is a record of the reasons for dismissal.<\/p>\n<p>It also allows drivers to contest their dismissal to keep their personal license. However, it seems Uber doesn\u2019t always provide a clear explanation.<\/p>\n<p>One driver <a href=\"https:\/\/www.bbc.com\/news\/business-54698858\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">told the BBC<\/a> that he had a 4.94 rating, but was unable to log into the app one morning. After calling customer support he was told his account had been deactivated for \u201cfraudulent activities.\u201d Despite more calls and emails over a six-month period, that driver was never given more explanation as to what his \u201cfraudulent activities\u201d had actually been.<\/p>\n<p>According to the quartet\u2019s legal representation, Uber has never given drivers access to any evidence or data held against them, nor did it allow them to challenge their termination.<\/p>\n<p>The fact that this is the first time Uber drivers have come together to challenge their dismissals on the grounds of GDPR law makes this a bit of a landmark case. If the drivers can have their terminations successfully overturned, it could pave ground for other drivers in similar situations to build a class action lawsuit against the ride-sharing company.<\/p>\n<p><span>Earlier this year, another group of Uber drivers logged a case against the company&nbsp;<\/span><a class=\"c-link\" href=\"https:\/\/thenextweb.com\/shift\/2020\/07\/20\/uk-uber-drivers-companys-euro-hq-prove-ride-hailing-business-employer-algorithm-transparency\/\" target=\"_blank\" rel=\"noopener noreferrer\" data-stringify-link=\"https:\/\/thenextweb.com\/shift\/2020\/07\/20\/uk-uber-drivers-companys-euro-hq-prove-ride-hailing-business-employer-algorithm-transparency\/\" data-sk=\"tooltip_parent\">seeking more transparency over how the platform\u2019s algorithm distributes ride requests<\/a>.
