{"id":894,"date":"2020-11-04T12:55:38","date_gmt":"2020-11-04T12:55:38","guid":{"rendered":"https:\/\/thenextweb.com\/?p=1326719"},"modified":"2020-11-04T12:55:38","modified_gmt":"2020-11-04T12:55:38","slug":"prop-22-passes-uber-and-lyft-drivers-will-continue-as-independent-contractors-in-california","status":"publish","type":"post","link":"https:\/\/www.londonchiropracter.com\/?p=894","title":{"rendered":"Prop 22 passes: Uber and Lyft drivers will continue as independent contractors in California"},"content":{"rendered":"\n<p><span>As part of the US election ballot, voters in California also decided the fate of the state\u2019s Uber and Lyft drivers by deciding to have them classified as independent contractors.<\/span><\/p>\n<p><a href=\"https:\/\/mashable.com\/article\/prop-22-california-uber-lyft\/?europe=true&amp;utm_source=social&amp;utm_medium=twitter&amp;utm_campaign=mash-com-Tw-tech-link\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Reports say<\/a> that 58% of Californian voters voted in favor of Proposition 22, the proposal backed by Uber, Lyft, and DoorDash to campaign against AB5 legislation that would classify gig-workers as employees.<\/p>\n<p>It\u2019s hard to say if the voting public acted in their own interests or with the welfare of drivers in mind, though. Gig Workers Rising, a driver advocacy group, said it\u2019s a \u201closs for democracy that could open the door\u2026 [for] corps to write their own laws.\u201d<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\" readability=\"10.480825958702\">\n<p lang=\"en\" dir=\"ltr\">Billionaire corps just hijacked the ballot measure system in CA by spending millions to mislead voters. The most expensive ballot measure in U.S. history, is a loss for our democracy that could open the door to other attempts by corps to write their own laws. <\/p>\n<p>1\/X<\/p>\n<p>\u2014 Gig Workers Are Voting No On Prop 22 (@GigWorkersRise) <a href=\"https:\/\/twitter.com\/GigWorkersRise\/status\/1323892878263820289?ref_src=twsrc%5Etfw\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">November 4, 2020<\/a><\/p>\n<\/blockquote>\n<p>The Yes for Prop 22 campaign <a class=\"u-underline\" href=\"https:\/\/yeson22.com\/californians-approve-prop-22-providing-hundreds-of-thousands-of-drivers-independence-plus-benefits-and-protecting-the-services-millions-rely-on\/\" data-link-name=\"in body link\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">announced its victory<\/a> late on Tuesday, saying it is \u201ca win for drivers across California.\u201d<\/p>\n<p>Uber and Lyft have both previously said that prices would increase and drivers would have less flexibility if they had to abide by AB5 laws. Gig Workers Rising rebuffed these statements as nothing more than scare tactics to swing the vote in Uber and Lyft\u2019s favor.<\/p>\n<p>However, a <a href=\"https:\/\/www.sfchronicle.com\/business\/article\/Uber-Lyft-DoorDash-campaign-for-ballot-15090479.php\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">San Francisco Chronicle article<\/a> said the companies\u2019 labor costs could increase by 30% if drivers had to be recognized as employees. As a company that has <a href=\"https:\/\/www.theverge.com\/2020\/2\/6\/21126965\/uber-q4-earnings-report-net-loss-revenue-profit-2019\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">continually struggled to find profitability<\/a>, any operating cost increases would have undoubtedly led to increased costs for consumers or resulted in substantial internal cuts.<\/p>\n<p><em>[Read: <a href=\"https:\/\/thenextweb.com\/world\/2020\/08\/11\/4-ridiculously-easy-ways-you-can-be-more-eco-friendly\/\" target=\"_blank\" rel=\"noopener noreferrer\">4 ridiculously easy ways you can be more eco-friendly<\/a>]<\/em><\/p>\n<p><a href=\"https:\/\/www.sacbee.com\/news\/politics-government\/capitol-alert\/article246312485.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">According to internal surveys<\/a>, drivers have continually said that they want to remain as independent contractors. Many believed that being made employees would cut their earnings, and remove any flexibility over working on their own terms. <span>While an independent study corroborated these findings many claimed they&nbsp;<\/span><span><a href=\"https:\/\/www.sacbee.com\/news\/politics-government\/capitol-alert\/article246312485.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">asked slanted questions<\/a> that pushed drivers towards Prop 22<\/span><span>.<\/span><\/p>\n<p>That begins to make sense when we consider an OpEd written by Uber CEO Dara Khosrowshahi, <a href=\"https:\/\/www.nytimes.com\/2020\/08\/10\/opinion\/uber-ceo-dara-khosrowshahi-gig-workers-deserve-better.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">published by New York Times earlier this year<\/a>, which claimed the company couldn\u2019t offer flexibility to drivers if they had to be made employees. The piece was <a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=3488009\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">criticized by academics<\/a> saying that Uber had continually conflated employment status with the ability to offer workers a flexible work environment.<\/p>\n<p>UC Berkeley economics professor Michael Reich said Uber\u2018s surveys falsely portrayed a world where drivers would have little or no flexibility without Prop. 22, the <a href=\"https:\/\/www.sacbee.com\/news\/politics-government\/capitol-alert\/article246312485.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Sacramento Bee reports<\/a>.<\/p>\n<p>It also recently came to light that Uber and Lyft <a href=\"https:\/\/www.cnet.com\/news\/uber-and-lyft-paid-400k-to-firm-conducting-independent-studies-on-proposition-22\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">paid more than $400,000 to the agencies<\/a> that carried out these supposed independent surveys of drivers.<\/p>\n<p><span>Proposition 22 has been one of the most hotly fought and expensive legal battles in the&nbsp;<span class=\"c-mrkdwn__highlight\">mobility<\/span><span>&nbsp;sector. In fact, it\u2019s the most expensive ballot campaign measure in California\u2019s history<\/span><\/span>.
