{"id":9195,"date":"2021-11-29T13:05:46","date_gmt":"2021-11-29T13:05:46","guid":{"rendered":"http:\/\/TheNextWeb=1374383"},"modified":"2021-11-29T13:05:46","modified_gmt":"2021-11-29T13:05:46","slug":"its-2021-can-we-criminalize-cyberflashing-already","status":"publish","type":"post","link":"https:\/\/www.londonchiropracter.com\/?p=9195","title":{"rendered":"It\u2019s 2021, can we criminalize cyberflashing already?"},"content":{"rendered":"\n<p>\u201cCyberflashing\u201d \u2013 the unsolicited sending of photos or videos of genitals \u2013 may soon be a <a href=\"https:\/\/www.bbc.co.uk\/news\/uk-politics-59391603\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">crime<\/a> in England and Wales.<\/p>\n<p><a href=\"https:\/\/yougov.co.uk\/topics\/politics\/articles-reports\/2018\/02\/16\/four-ten-female-millennials-been-sent-dick-pic\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Surveys have found<\/a> that <a href=\"https:\/\/www.bbc.co.uk\/news\/newsbeat-59139399\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">nearly half<\/a> of young adult women have been sent unwanted, graphic images by men. Receiving so-called <a href=\"https:\/\/www.bustle.com\/p\/this-woman-dressed-up-as-unsolicited-nsfw-pic-is-a-true-internet-hero-72430\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">dick pics<\/a> is especially common among women who use dating apps. In some high-profile cases, people have even been <a href=\"https:\/\/www.bbc.co.uk\/news\/technology-33889225\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">AirDropped images<\/a> by the <a href=\"https:\/\/www.huffingtonpost.co.uk\/entry\/cyber-flashing-uk-reports-hidden-problem_uk_5992d291e4b08a24727728fe\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">hundreds<\/a> while traveling on public transport. In 2019, <a href=\"https:\/\/www.standard.co.uk\/news\/crime\/cyberflashing-trains-british-transport-police-a4365886.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">British Transport Police found<\/a> that 88% of those targeted were women.<\/p>\n<p>Cyberflashing has clear parallels with <a href=\"https:\/\/theconversation.com\/dickpics-are-no-joke-cyber-flashing-misogyny-and-online-dating-53843\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">indecent exposure<\/a>, which is already a sexual offense carrying a maximum two-year custodial sentence. But it is not clear whether this law applies to digital forms of exposure.<\/p>\n<p>Campaigners, <a href=\"https:\/\/hansard.parliament.uk\/Commons\/2021-01-14\/debates\/0D60F93C-386F-49F2-8526-8FA1CDEFE765\/details#contribution-6CCE7CBA-9603-4FE7-B0ED-DE2226269B9D\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">MPs<\/a> and the dating app <a href=\"https:\/\/bumble.com\/en\/the-buzz\/bumble-uk-government-cyberflashing-law-crime\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Bumble<\/a> are all calling for the law to change to close this loophole. Politicians are now discussing how cyberflashing may be included in the forthcoming Online Safety bill.<\/p>\n<p>Criminalizing cyberflashing specifically as a sexual offense would bring a host of <a href=\"https:\/\/committees.parliament.uk\/writtenevidence\/35440\/html\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">legal benefits<\/a> to victims and could help police identify perpetrators at risk of causing further sexual harm. Hopefully, it may also deter would-be cyberflashing offenders from hitting \u201csend\u201d.<\/p>\n<h2>Redressing harm<\/h2>\n<p>Legal recognition would provide those who suffer harm as a result of cyberflashing a means of redress. While some women try to \u201claugh off\u201d an unwanted photo of a penis, for others it can be frightening, distressing, or humiliating.<\/p>\n<p>At its core, the non-consensual nature of this conduct makes it violating and intrusive, as women\u2019s <a href=\"https:\/\/www.huffingtonpost.co.uk\/entry\/cyberflashing-70-women-on-what-its-like-to-be-sent-unsolicited-dick-pics_uk_5cd59005e4b0705e47db0195?utm_hp_ref=uk-cyberflashing\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">testimonies<\/a> stress. Likewise, a <a href=\"https:\/\/news.iu.edu\/stories\/2020\/08\/iub\/releases\/05-kinsey-institute-study-reactions-to-unsolicited-sexting-differ-by-gender.html\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Kinsey Institute study<\/a> found 70% of women who responded to a survey reported negative reactions to unwanted penis images, most commonly feeling \u201cgrossed out\u201d and \u201cviolated\u201d.<\/p>\n<p>Cyberflashing may also be experienced as harassment. For example, consider how a woman may feel when a man who has been messaging persistently \u2013 despite her ignoring him \u2013 sends an image of an erect penis. This could be seen as confusing or even threatening.<\/p>\n<p>This scenario happened to a woman I spoke to in a research interview. She described the incident as \u201cshocking\u201d and that she became \u201cscared by him\u201d. Women may <a href=\"https:\/\/policy.bristoluniversitypress.co.uk\/the-right-amount-of-panic\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">fear<\/a> a man\u2019s intrusive behavior will escalate to violence. This brings us to another argument for criminalizing cyberflashing.<\/p>\n<p>After it was revealed former Met Police officer Wayne Couzens had repeatedly exposed himself in person before he raped and murdered Sarah Everard, fears that indecent exposure acts as a <a href=\"https:\/\/www.telegraph.co.uk\/news\/2021\/07\/09\/nearly-800-men-prosecuted-flashing-last-year-despite-growing\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">gateway<\/a> to other sex crimes have been heightened.<\/p>\n<p>In Scotland, where cyberflashing has been <a href=\"https:\/\/www.askthe.scottish.police.uk\/content\/Q989.htm\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">classed as a sexual offense<\/a> for over a decade, police have seen cases of offenders brought to justice for serious sexual crimes after coming onto their radar through a <a href=\"https:\/\/www.huffingtonpost.co.uk\/entry\/would-making-cyberflashing-illegal-stop-people-sending-dick-pics_uk_5c50674fe4b0d9f9be6951ce\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">cyberflashing report<\/a>.<\/p>\n<p>One of the much-hoped-for effects of a new cyberflashing law is that it will deter would-be perpetrators by clearly signaling the behavior as criminal. As Whitney Wolfe Herd, Bumble\u2019s founder and chief executive <a href=\"https:\/\/graziadaily.co.uk\/life\/in-the-news\/bumble-cyberflashing-campaign-whitney-wolfe-herd-unsolicited-dick-pics\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">puts it<\/a>: \u201cIf flashing won\u2019t fly on the street \u2026 it shouldn\u2019t be tolerated in your inbox.\u201d<\/p>\n<p>The existence of legal sanctions will help signal that cyberflashing is morally wrong and should not be accepted by society as just another unsavory online behavior.<\/p>\n<h2>The proposal<\/h2>\n<p>In a welcome step, the Law Commission has <a href=\"https:\/\/www.lawcom.gov.uk\/greater-protections-for-victims-of-online-abuse-proposed-by-law-commission\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">recommended<\/a> amending Section 66 under the Sexual Offences Act 2003 to ensure cyberflashing is clearly included in the indecent exposure law. This recognizes the nature of the behavior and its effects.<\/p>\n<p>Their proposal also retains the mental or \u201cfault\u201d element of the original offense: that in sending \u201can image or video of any person\u2019s genitals\u201d the defendant <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/2003\/42\/section\/66\/wales\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">intends<\/a> to cause alarm, distress, or humiliation. It is here there are some concerns about proving intent. The extent to which a law against cyberflashing acts as an effective deterrent will depend on how enforceable it is.<\/p>\n<p>Some experts <a href=\"https:\/\/s3-eu-west-2.amazonaws.com\/lawcom-prod-storage-11jsxou24uy7q\/uploads\/2021\/07\/Modernising-Communications-Offences-2021-Law-Com-No-399.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">consulted<\/a> in the drafting of this proposed reform argued a focus on malicious motives would put an <a href=\"https:\/\/socialandlegalstudies.wordpress.com\/2020\/07\/06\/criminalise-cyberflashing-now\/\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">unreasonably high<\/a> burden of proof on prosecutors. With cyberflashing, it could be difficult or impossible to demonstrate such intent, given how often this behavior is normalized and trivialized, for example, as \u201cmisguided flirting\u201d.<\/p>\n<p>Fortunately, the Law Commission has <a href=\"https:\/\/s3-eu-west-2.amazonaws.com\/lawcom-prod-storage-11jsxou24uy7q\/uploads\/2021\/07\/Summary-of-Modernising-Communications-Offences-2021.pdf\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">added<\/a> another possible element that could allow for a wider range of cases to be tried and convicted. A defendant may be found guilty if it\u2019s proved they sent a genital image (or video) \u201cfor the purpose of obtaining sexual gratification\u201d and were \u201creckless\u201d as to whether it would cause alarm, distress, or humiliation. Proving a sexual motive should be an easier task for prosecutors. The addition of recklessness also sends a clear message: if you cyberflash and cause someone harm, it is not good enough to simply claim you didn\u2019t mean to.<\/p>\n<p>As the government turns its attention to the <a href=\"https:\/\/www.gov.uk\/government\/publications\/draft-online-safety-bill\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Online Safety Bill<\/a>, it is now vital that legislation be passed to criminalize cyberflashing. We can no longer give carte blanche to those so inclined to expose themselves online. It is criminally wrong, and women have had enough.<!-- Below is The Conversation's page counter tag.
